Jared Restricted from Fast Food Competition?

Quick, call the antitrust division: Jared (of Subway fame) isn't allow to eat at other "quick-service" restaurants. Is "quick-service" what we call fast food now?

Via the Washington Post:

"I'm not allowed to go into other quick-service restaurants," he explains wearily. It is barely 6:30 a.m. and Jared has been up for two hours, having pitched the upcoming American Heart Walk on the local "Good Morning Mississippi" TV show, and he desperately needs a coffee fix.

To what extent do you think that part of his agreement is enforceable? Perhaps he could put on sunglasses and get away with it and not ask legal questions.

The closest analogy for this is a covenant not to compete, which are evaluated by "reasonableness" in time and scope. Jared's probably still being paid by Subway, and if he quit, he probably could eat elsewhere.

We probably shouldn't feel too sorry for Jared, depending on how much he is being paid. After all, he supposedly has proven the benefits of avoiding other QSRs.
