MAKE NO EXPRESS REPRESENTATIONS OR WARRANTIES
ABOUT OUR SERVICES AND DISCLAIM ANY IMPLIED
WARRANTIES, INCLUDING, BUT NOT LIMITED TO,
WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE OR USE OR NON-INFRINGEMENT.
Keep
you out of a courtroom:
YOU
AND WE EACH WAIVE OUR RESPECTIVE RIGHTS TO A
TRIAL BY JURY OF ANY AND ALL CLAIMS OR CAUSES
OF ACTION (INCLUDING COUNTERCLAIMS) RELATED
TO OR ARISING OUT OF THIS AGREEMENT BROUGHT
BY EITHER ONE OF US AGAINST THE OTHER. EACH
OF US AGREES THAT ANY CLAIM OR CAUSE OF
ACTION WILL BE TRIED BY A COURT TRIAL WITHOUT
A JURY. THIS WAIVER APPLIES TO THIS AGREEMENT
AS AMENDED OR MODIFIED. THIS SECTION SURVIVES
TERMINATION OF THIS AGREEMENT.
Tie
you to a different state's law:
This
Agreement is governed by and construed under
the laws of the state of Missouri without
regard to choice of law principles. You agree
to submit yourself to the personal
jurisdiction of the courts of the state of
Missouri.
Waive
your right to class action status in a
lawsuit:
YOU
AGREE THAT ALL CLAIMS BETWEEN YOU AND SPRINT
PCS RELATED TO THIS AGREEMENT WILL BE
LITIGATED INDIVIDUALLY AND THAT YOU WILL NOT
CONSOLIDATE OR SEEK CLASS TREATMENT FOR ANY
CLAIM, UNLESS PREVIOUSLY AGREED TO IN WRITING
BY BOTH OF US.
Charge
you a large fee to prevent you from switching
service to a decent provider:
EARLY
TERMINATION FEE OF $150 as liquidated
damages. We will automatically charge the
termination fee to your account if you
terminate your Services before the year is
up.
